These Terms of Use (“Terms”) govern your use of jazdesign.com, including our planning guides, Client Dashboard, digital content, consultations, design guidance services, and other services offered by JAZ Design Inc., doing business as JAZ Design (“JAZ Design,” “we,” “us,” or “our”).

By using the website, creating a Client Dashboard account, submitting information, purchasing a service, or agreeing to these Terms where prompted, you acknowledge that you have read and agree to these Terms and our Privacy Policy.

1. Our website and guidance services

JAZ Design provides interior design information, planning tools, consultations, and professional design guidance.

Free guides and general website content are provided for informational and planning purposes only and do not create a designer-client relationship.

When you purchase a consultation or other guidance service, the relationship is limited to the specific service described on the applicable service page. A consultation or guidance service does not create a full-service interior design engagement unless JAZ Design and the client enter into a separate written agreement.

2. Design guidance and your responsibilities

Our recommendations are based on the information, photographs, measurements, plans, questions, and other materials you provide.

Unless specifically included in the service you purchase, JAZ Design does not provide engineering, structural analysis, building-code review, construction drawings, contractor supervision, appraisal, authentication, legal advice, or other services requiring a separate licensed professional.

You remain responsible for final measurements, purchases, contractor selection, construction decisions, permits, code compliance, installation, and implementation.

Any budgets, costs, product information, dimensions, availability, or other estimates discussed during a guide or consultation are for planning purposes and are not guarantees.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use our guides, Client Dashboard, or paid services.

You are responsible for providing accurate information and for ensuring that any information or materials you submit belong to you or are provided with permission.

4. Client Dashboard and submitted materials

The Client Dashboard allows you to access certain project information, guide submissions, and files associated with your account.

You may upload photographs, plans, drawings, documents, inspiration images, and other project materials for JAZ Design to review.

By providing materials to us, you confirm that you have the right to provide them and give JAZ Design permission to view, store, copy, and use them only as reasonably necessary to provide the requested service. You retain ownership of your materials.

JAZ Design will not use client photographs, project materials, or other submitted content for advertising, portfolio use, social media, or other promotional purposes without your permission.

Please do not upload Social Security numbers, government identification numbers, financial account information, medical information, or other sensitive information that is not necessary for your project.

You are responsible for keeping access to your email and Client Dashboard secure.

5. Purchases, scheduling, cancellations, and refunds

Prices and the scope of each paid service are described on the applicable service page at the time of purchase. Payment is required before a paid consultation or guidance service is scheduled or performed unless otherwise agreed in writing.

If you need to reschedule a consultation, contact JAZ Design. Rescheduling is subject to availability.

If you cancel before JAZ Design has begun reviewing your submitted materials or preparing for the service, we will consider reasonable refund requests. Once JAZ Design has begun reviewing materials, preparing recommendations, or providing the purchased service, some or all of the fee may be non-refundable based on the work already performed.

Any specific cancellation or refund terms stated on a service or purchase page will apply to that service.

6. Intellectual property

The JAZ Design website, planning guides, written content, graphics, questionnaires, downloads, photographs owned by JAZ Design, and other original materials are protected by intellectual property laws.

You may use guides and materials provided to you for your own personal project. You may not reproduce, sell, distribute, publish, commercially exploit, scrape, reverse-engineer, or create derivative products from JAZ Design materials without our written permission.

Information and materials you submit remain yours.

7. Acceptable use

You agree not to:

• provide false, misleading, unlawful, or unauthorized information;
• submit another person’s private information without permission;
• attempt to access another client’s account, records, or files;
• interfere with or attempt to bypass the security of the website, guides, Client Dashboard, database, or related systems;
• introduce malicious software or otherwise disrupt the operation of the website; or
• use JAZ Design’s website or materials for an unlawful purpose.

8. Third-party services and links

Our website and services rely on third-party providers for functions such as website hosting, database storage, authentication, email delivery, payment processing, and other technology services.

We may also provide links to products, artists, contractors, retailers, manufacturers, or other third parties. JAZ Design does not control third-party websites, products, services, pricing, availability, warranties, or business practices and is not responsible for them.

9. Website availability

We make reasonable efforts to keep the website, guides, and Client Dashboard available and secure, but we cannot guarantee uninterrupted access or that technical errors or data loss will never occur.

We may modify, suspend, or discontinue website features or services when reasonably necessary.

10. Disclaimer of warranties

To the fullest extent permitted by law, the website, guides, digital materials, and online tools are provided “as is” and “as available.”

Design consultations and guidance reflect professional judgment based on the information available at the time. Design decisions are inherently subjective, and JAZ Design cannot guarantee a particular construction, financial, aesthetic, resale, or other outcome.

11. Limitation of liability

To the fullest extent permitted by law, JAZ Design Inc. and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, guides, Client Dashboard, or guidance services.

For claims relating to a paid service, JAZ Design’s total liability will not exceed the amount you paid JAZ Design for the specific service giving rise to the claim.

For claims relating only to free website content or a free guide, total liability will not exceed one hundred U.S. dollars (US$100).

Nothing in these Terms limits rights or remedies that cannot legally be limited or excluded.

12. Indemnification

You agree to indemnify and hold harmless JAZ Design Inc. and its owners, employees, and contractors from claims, losses, or expenses arising from your misuse of the website or services, your violation of these Terms, or your violation of another person’s rights.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We may update these Terms from time to time as our website or services change. When we do, we will revise the effective date above. Material changes may also require you to agree to the updated Terms when using certain website features.

15. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles.

To the extent permitted by law, disputes arising from these Terms or our services will be handled by the state or federal courts located in Massachusetts.
